Microservix respects the intellectual property rights of others and expects users of its services to do the same. This Digital Millennium Copyright Act Policy ("DMCA Policy") describes how Microservix responds to claims of copyright infringement submitted through our platform and services accessible at microservix.com.
1. Overview
In accordance with the Digital Millennium Copyright Act ("DMCA") and other applicable intellectual property laws, Microservix will respond promptly to claims of copyright infringement that are reported to our designated copyright agent. If you believe that content available through our services infringes one or more of your copyrights, please submit a written notification containing the information described below.
2. Reporting Copyright Infringement
If you are a copyright owner, or authorized to act on behalf of a copyright owner, and you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please submit a notice to our designated agent with the following information:
2.1 Required Information for a Valid Notice
Your written notice must include all of the following elements to be considered valid and actionable:

| Accuracy statement | A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed |
2.2 Submitting Your Notice

Notices submitted by email will be processed more quickly. Please include "DMCA Copyright Notice" in the subject line of your email.
3. Counter-Notification Procedure
If you believe that content you posted was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification to our designated agent. A valid counter-notification must include the following:
3.1 Required Information for a Counter-Notice
Your counter-notification must contain all of the following:

| Consent to jurisdiction | Your name, address, and telephone number, and a statement that you consent to the jurisdiction of a competent judicial authority and that you will accept service of process from the person who provided the original infringement notification |
3.2 Processing of Counter-Notices
Upon receipt of a valid counter-notification, Microservix will transmit a copy to the original complaining party. If the original complaining party does not notify us within a reasonable period that they have filed an action seeking a court order to restrain the allegedly infringing activity, we may, in our sole discretion, restore the removed or disabled material.
4. Repeat Infringer Policy
Microservix maintains a policy of terminating, in appropriate circumstances, the accounts of users who are determined to be repeat infringers. A repeat infringer is any user who has been the subject of two or more valid DMCA takedown notices. We reserve the right to terminate the account of any user found to repeatedly infringe the copyrights of others, with or without prior notice.
5. Misrepresentation
Please be aware that under applicable law, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability. Before submitting a notice or counter-notice, you should carefully consider whether the use of the copyrighted material in question may be protected by fair use, fair dealing, or a similar doctrine, as such material should not be the subject of a takedown notification.
6. Modification of Content
Upon receipt of a valid and complete DMCA takedown notice, Microservix reserves the right to:
Remove or disable access to the allegedly infringing content promptly.
Notify the user who posted the content that it has been removed or disabled.
Terminate access for users who are found to be repeat infringers.
Restore content following receipt of a valid counter-notification, subject to the procedures described above.
7. Limitations
This DMCA Policy applies solely to copyright infringement claims. Claims relating to trademark infringement, defamation, privacy violations, or other legal matters should be directed to our general contact address and will be handled under separate policies and procedures applicable to those types of claims.
Microservix does not act as a mediator between copyright owners and alleged infringers. Our role is limited to processing valid DMCA notices in accordance with applicable law and our internal policies.
